The International Criminal Tribunal for the former Yugoslavia
The ICTY was founded in 1993 as a United Nations court to deal with the war crimes that took place during the conflicts in the Balkans in the 1990’s. In its precedent-setting decisions on genocide, war crimes and crimes against humanity, the Tribunal has shown that an individual’s senior position can no longer protect them from prosecution.
The Tribunal has laid the foundations for what is now the accepted norm for conflict resolution and post-conflict development across the globe, specifically that leaders suspected of mass crimes will face justice. The Tribunal has proved that efficient and transparent international justice is possible. We will try to visit a hearing, but if it is decided that the hearing is closed at the last minute we will receive a presentation and watch a documentary. (http://www.icty.org/en/about)
The ICC is an International Court that has the ability to try individuals for committing war crimes, crimes against humanity and genocide. The Court is participating in a global fight to end impunity, and through international criminal justice, the Court aims to hold those responsible accountable for their crimes and to help prevent these crimes from happening again. We will visit a hearing depending on it if it an open hearing, and receive a presentation about the Court and its recent developments. (https://www.icc-cpi.int/about
The International Criminal Court (ICC) is an independent, permanent court that tries persons accused of the most serious crimes at an international level, namely genocide, crimes against humanity and war crimes. The ICC is based on a treaty, joined by 105 countries.
The ICC is a court of last resort. It will not act if a case is investigated or prosecuted by a national judicial system unless the national proceedings are not genuine, for example if formal proceedings were undertaken solely to shield a person from criminal responsibility. In addition, the ICC only tries those accused of the gravest crimes.
The excursion to the ICC consists out of attending a hearing and a general presentation by an ICC representative.
The European Council agreed that a unit (Eurojust) should be set up, composed of national prosecutors, magistrates, or police officers of equivalent competence, detached from each Member State according to their own legal systems. It was established in 2002. In 2003, Eurojust moved to its seat in The Hague.
Eurojust stimulates and improves the coordination of investigations and prosecutions between the competent authorities in the Member States.Eurojust’s competence covers the same types of crime and offences for which Europol has competence, such as terrorism, drug trafficking, trafficking in human beings, counterfeiting, money laundering, computer crime, crime against property or public goods including fraud and corruption, criminal offences affecting the European Community’s financial interests, environmental crime and participation in a criminal organisation.
